How to File Trademark Registration in Mumbai?

A Mumbai-based applicant follows the Indian trademark system under the Trade Marks Act, 1999 and Trade Marks Rules, 2017. The process is national, and most filings can be handled electronically.

1. Conduct a trademark search

Search for identical and deceptively similar marks before filing. The search should be designed around the relevant classes and should consider phonetic and conceptual similarity rather than only exact spelling.

2. Confirm ownership and classes

Identify the correct proprietor before the application is filed. Then determine the goods or services for which protection is needed under the applicable classification system. A single commercial brand may require filings in more than one class.

3. File Form TM-A

A standard application for registration is made in Form TM-A with the prescribed fee. The application includes the mark, proprietor details, goods or services and, where applicable, the claimed date of use supported by the required statement or evidence.

4. Examination

The Registry examines the application, including earlier marks on record. An examination report may raise objections, commonly under sections 9 or 11. The applicant can respond with legal submissions and evidence and may receive a hearing.

5. Journal publication and opposition

If accepted, the application is advertised in the Trade Marks Journal. A notice of opposition may be filed within four months from publication. An unopposed application, or one that succeeds after opposition, can proceed to registration.
